Terms and Conditions of the Colores Art Gallery Online Store

§ 1. Preliminary Provisions

1.1. These terms and conditions define the rules of operation of the online store run by Michał Wilkonski Calle Denia 60 46006 Valencia Y7013793A, hereinafter referred to as the "Seller".

1.2. The online store run by the Seller is available at https://coloresartgallery.com.

1.3. The terms and conditions are available on the website of the store.

1.4. All information provided on the store's website is for informational purposes only and does not constitute an offer within the meaning of the Civil Code.

1.5. All rights to the online store, including its content, graphics, and logo, are the property of the Seller and are protected by intellectual property law.

 

§ 2. Definitions

2.1. Consumer - a natural person conducting a transaction with the Seller within the online store, not directly related to their business or professional activity.

2.3. Buyer - a natural person, legal entity, or organizational unit without legal personality, conducting a transaction with the Seller within the online store.

 

§ 3. Technical Requirements

3.1. To use the online store, the Buyer must have access to a device with internet access and an internet browser.

3.2. The online store operates on the latest versions of popular internet browsers such as Mozilla Firefox, Google Chrome, Microsoft Edge, and Safari.

3.3. The Seller is not responsible for errors resulting from the Buyer's internet browser not meeting the technical requirements of the online store.

 

§ 4. Contact with the Store 4.1. Any questions, comments, or complaints regarding the online store can be submitted by the Buyer via the contact form available on the store's website or by email at office@coloresartgallery.com.

4.2. The online store does not conduct sales by phone.

 

§ 5. Purchase Procedure in the Store, Ordering Rules

5.1. The Buyer can make purchases in the online store without registration.

5.2. By placing an order in the online store, the Buyer consents to the processing of their personal data in accordance with the Seller's privacy policy.

5.3. When placing an order, the Buyer must provide accurate contact details and delivery address. In case of providing false information, the Seller is not responsible for the inability to deliver the goods.

5.4. Placing an order by the Buyer is equivalent to concluding a sales contract in accordance with the conditions specified in the order and these terms and conditions.

5.5. The order is processed after the Seller confirms its acceptance. This confirmation is sent to the Buyer's provided email address or in another manner specified by the Seller.

5.6. In case of inability to fulfill the order, the Seller promptly notifies the Buyer and refunds all payments made by the Buyer.

 

§ 6. Payments and Delivery Methods

6.1. All prices listed in the online store are expressed in Polish zloty and include VAT.

6.2. The Buyer can pay for the order using the Przelewy24 payment gateway, selecting a preferred payment method such as BLIK, payment card, or quick transfer.

6.3. The Seller offers delivery of ordered products via courier service.

6.4. Delivery costs are specified during the ordering process and depend on the country of delivery.

 

§ 7. Order Fulfillment, Execution of the Sales Contract

7.1. The order is processed by the Seller within 2 business days from the moment of its confirmation.

7.2. The Seller undertakes to deliver the ordered goods in an undamaged state and as described on the online store's website.

7.3. In case of violation of the Buyer's rights due to defective goods or non-compliance with the description, the Buyer may use the right of complaint.

7.4. The Seller has the right to refuse to fulfill the order if the Buyer violates the terms and conditions or has outstanding payments for previous orders.

7.5. If the Buyer chooses bank transfer as the payment method, order fulfillment begins after the payment is credited to the Seller's bank account.

7.6. In case of inability to fulfill the order due to stock unavailability, the Seller promptly notifies the Buyer and refunds all payments made by the Buyer.

 

§ 8. Right of Withdrawal from the Contract, Consequences of Withdrawal, Exceptions to the Right of Withdrawal (Digital Content)

8.1. The Buyer has the right to withdraw from the contract without providing a reason within 14 days from the date of receiving the ordered goods.

8.2. In case of withdrawal from the contract, the Buyer is obliged to promptly return the goods in an undamaged state, not showing signs of use or installation, and in accordance with the description provided on the online store's website.

8.3. The costs of returning the goods are borne by the Buyer, unless the Seller has agreed to cover them.

8.4. The Seller refunds the amount paid by the Buyer for the ordered goods and delivery costs no later than within 14 days from the date of receiving the returned goods.

8.5. The right to withdraw from the contract does not apply to goods manufactured or delivered according to the Buyer's specifications and to digital content delivered with the Buyer's consent before the withdrawal period expires.

 

§ 9. Complaints, Complaint Procedure

9.1. In case of discovering defective goods or non-compliance with the description, the Buyer can use the right of complaint.

9.2. Complaints should be submitted using the form available on the online store's website or in another manner specified by the Seller.

9.3. The Seller undertakes to review the complaint within 14 days from the date of its receipt and inform the Buyer of the result of the complaint procedure.

9.4. If the complaint is accepted, the Seller undertakes to repair the goods or replace them with new defective products.

9.5. The Seller bears the costs of the complaint, including the costs of returning the goods.

 

§ 10. Out-of-Court Complaint and Redress Methods

10.1. The Buyer has the right to use out-of-court complaint and redress methods.

10.2. The Buyer can use mediation or proceedings before a consumer arbitration court.

10.3. Information on dispute resolution methods is available on the website of the Office of Competition and Consumer Protection (UOKiK) and on the Consumer Rights Ombudsman website.

10.4. The Buyer can also use the Online Dispute Resolution (ODR) platform operated by the European Commission, available at: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=PL.

 

§ 11. Personal Data 11.1. The Seller is the administrator of the Buyer's personal data.

11.2. Personal data is processed in accordance with applicable law and the privacy policy available on the store's website.

11.3. The Buyer has the right to access and correct their personal data.

11.4. Providing personal data is voluntary but necessary for order fulfillment and contact regarding order fulfillment.

 

§ 12. Final Provisions

12.1. The terms and conditions come into force on the day of their publication on the store's website.

12.2. The Seller reserves the right to change the terms and conditions. Changes take effect on the day of their publication on the store's website.

12.3. In matters not regulated by these terms and conditions, Polish law applies, in particular the Civil Code and the Consumer Rights Act.

12.4. Any disputes arising from the execution of the sales contract or the application of these terms and conditions are settled by the court competent for the Seller's registered office.

12.5. The Buyer has the right to submit complaints in accordance with the procedure specified in these terms and conditions and Polish law.

12.6. All information regarding the store and orders can be obtained by contacting the Customer Service Office via email or the contact form on the store's website.

12.7. All information and materials available on the store's website are protected by copyright and intellectual property rights and are the property of the store or other entities cooperating with the store. Use of these materials without the owner's consent is prohibited.

12.8. The terms and conditions are an integral part of the sales contract between the Buyer and the Seller.

12.9. The terms and conditions are available on the store's website and can be provided to the Buyer in electronic form upon request.

12.10. These terms and conditions were drawn up in English and can be provided in other languages through translations. In case of discrepancies between different versions of the terms and conditions, the English version prevails.

12.11. These terms and conditions are effective from 01-06-2024.
